The EMC evaluation: the difference between $2,500 and $10,000

Florida PIP gives you up to $10,000 in combined medical and disability benefits after a crash. But you only reach that full amount if a qualified provider determines you had an emergency medical condition. Without that determination, your care is capped at $2,500.

What an EMC determination actually is

An emergency medical condition, or EMC, is a clinical finding. A provider examines you, documents what they find, and determines whether your injuries meet the standard set in Florida law. It is not paperwork you can request and it is not something a clinic can promise you in advance. It is a medical judgment, and it has to be supported by the exam.

What it is not is automatic. Plenty of crash patients finish treatment never knowing the determination was available to them, and find out their benefits stopped at $2,500 only when the bills arrive.

Not every provider can make the determination

This is the part most people never hear. Florida Statute 627.736 lists exactly who may determine that an emergency medical condition exists: a medical or osteopathic physician, a dentist, a physician assistant, or an advanced practice registered nurse.

A chiropractic physician is not on that list. A chiropractor can absolutely treat you, and a visit to one does satisfy the 14-day deadline. But a chiropractor alone cannot make the determination that opens the full $10,000. If the clinic you choose has no medical provider on staff, that door stays closed no matter how much care you receive.

Our clinic has an advanced practice registered nurse on site — one of the provider types Florida law names. When you come in, you get both the hands-on care and the medical evaluation, in the same building, on the same visit. If your injuries meet the criteria, the determination can be made here. If they don't, we will tell you that plainly rather than bill you toward a number you were never going to reach.

What happens at the visit

  1. A full injury exam — orthopedic, neurological, range of motion.
  2. Imaging if the exam calls for it.
  3. A medical evaluation by our provider, including the EMC determination where the findings support one.
  4. A treatment plan, and we bill your PIP insurer directly.

The 14-day clock still applies

None of this matters if you miss the deadline. Florida law requires your first visit within 14 days of the crash. Miss it and the benefits can be denied outright — EMC or not. The determination can come at or after that first visit, but the visit itself cannot wait.
